…for the respondent no. 9-12
Affidavit of service filed by the petitioner is taken on record. The petitioner was appointed as a Physical Education Teacher on ad hoc temporary basis against sanctioned post in Municipal Girls High School, Darjeeling and was regularized in the said post on 13th June, 1992. She superannuated on 31st October, 2021. Pension Payment Order has not been issued in her favour till date and she has not received any retiral benefit after her retirement. In response to an application filed by her under the Right to Information Act, 2005 in this regard, she has been informed that since her service profile has
2 not been approved in the Integrated Online Salary Management System (IOSMS) and User ID and Password have not been issued by the Director of Local Bodies, West Bengal submission of pension through the e-Pension portal was not possible. The petitioner seeks a direction upon the Director of Local Bodies, West Bengal to take necessary steps so that the petitioner is able to receive her pension and other retiral benefits at the earliest. Learned counsel for the State accedes to the contention of the Executive Officer, Darjeeling Municipality in the reply sent to the petitioner in respect of the application under the Right to Information Act. In view of the above, the Director, Directorate of Local Bodies, being the 6th respondent is directed to take necessary steps in this regard including issuance of User Id and Password so that the petitioner is able to receive her pension and other retiral benefits at the earliest. The entire exercise shall be completed by the said respondent within 2 weeks from the date of communication of this order. The writ petition is disposed of accordingly. There shall however be no order as costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
3 Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
