1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 59/2026 registered at Police Station Mantown, District Sawai Madhopur for the offences under Sections 319(2), 318(4) and 61(2)(a) of BNS and Section 66D of IT Act.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the petitioner has been named by the other co-accused who is the main beneficiary and there is no link between the other co-accused Kirodi and the present petitioner. The entire amount received was deposited in the account of the other co-accused Kirodi and apart from the one criminal antecedents, in which the petitioner has already been acquitted, there are no criminal cases registered against the petitioner. The offences alleged against the accused-petitioner are exclusively
[2026:RJ-JP:13641] (2 of 2) [CRLMB-4609/2026] triable by Magistrate, the accused-petitioner is in custody since long and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the factual report.

As per the factual report, the amount was transferred in the account of the co-accused Kirodi, against whom three other complaints with regard to cyber fraud was registered at various places and apart from the disclosure statement of the other co- accused, there is no other substantive evidence available on record that the account of the co-accused was operated or maintained by the present petitioner, therefore, considering the aforesaid facts, I deem it just and proper to enlarge the accused- petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Abhishek S/o Raghuveer, in connection with FIR No. 59/2026 registered at Police Station Mantown, District Sawai Madhopur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
