IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENTS TO MAINTAIN STATUS QUO IN RESPECT OF THE SCHEDULE PROPERTY FOR A PERIOD OF FOUR WEEKS TILL THE PETITIONER HAS AN OPPORTUNITY TO FILE AN APPEAL AS AGAINST THE ORDER DATED 06.01.2026 ON I.A. NO. 3 IN COM.O.S.NO.3/2025 ON THE FILE OF THE PRINCIPAL DISTRICT AND SESSIONS JUDGE, RAMANAGAR AND ETC. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MS. JUSTICE TARA VITASTA GANJU ORAL ORDER 1. The present petition has been filed under Article 227 of the Constitution of India by the petitioner/plaintiff seeking to challenge an order dated 06.01.2026 in O.S.No.3/2025 passed by the Principal District and Sessions Judge, Ramanagar (hereinafter referred to as the “Impugned Order”). By the Impugned Order, the application under Order 39 Rule 1 and 2 of the CPC, 1908 filed by the petitioner/plaintiff has been dismissed by the learned Trial Court. - 4 - HC-KAR NC: 2026:KHC:1267 WP No. 488 of 2026 2. At the outset, learned counsel for the petitioner submits that the translated copy of the Impugned Order has been placed on record. 3. Learned counsel for the petitioner further seeks to rely upon an order passed by the co-ordinate bench of this Court dated 24.10.2025 in W.P.No.23973/2025 (Annexure-A) to submit that even previously the learned Trial Court had passed a direction denying an urgent ex parte ad-interim injunction and that the said direction was challenged by the petitioner in the aforesaid writ petition. The co-ordinate bench of this Court by the order dated 24.10.2025 had passed an order of status quo to be maintained in respect of the suit schedule property until the application under Order 39 Rule 1 and 2 of the CPC is decided by the learned Trial Court. 4. Learned counsel for the petitioner submits that her limited grievance in the present petition is that the order of status quo granted by this Court on 24.10.2025 be continued for a period two weeks to enable her to take steps against the Impugned Order. - 5 - HC-KAR NC: 2026:KHC:1267 WP No. 488 of 2026 5. The Impugned Order has dismissed the application under Order 39 Rule 1 and 2 of CPC. Since, a co-ordinate Bench had previously granted an order of status quo, it would be in the fitness of things to extend the said order to allow the petitioner/plaintiff to take appropriate steps against the Impugned Order. Accordingly, the order of status quo is extended by a period of two weeks. It is however made clear that since the petition is being disposed of without notice to the respondents, the copy of the order passed today will be supplied to the respondents once it is uploaded. In addition, the direction of status quo shall automatically come to an end on the expiry of two weeks from today. 6. The petition is disposed of in the aforegoing terms. All pending applications stand closed. 7. The parties shall act on the digitally signed copy of the order.
