1. The instant bail application has been filed by the petitioner under Section 483 of B.N.S.S. in connection with FIR No. 58/2025 registered at Police Station Sadar Tonk, District Tonk, for offence(s) under Sections 109(2), 3(5) of B.N.S. and Section 3/25 of the Arms Act.
2. Learned counsel for the petitioner submits that the present matter pertains to a bail jump. After getting the benefit of bail, the petitioner could not appear before the learned Trial Court on 28.08.2025 and consequently, his bail bonds were forfeited.
Learned counsel further submits that the petitioner is in custody since 05.02.2026. Learned counsel also undertakes that the petitioner shall appear before the learned Trial Court on each and every date as fixed by the Court and the petitioner shall not make
[2026:RJ-JP:11541] (2 of 2) [CRLMB-3408/2026] any attempt to jump bail again, therefore, in the interest of justice, it is prayed that the bail application of the petitioner may be allowed.
3. Learned Public Prosecutor strongly opposed the bail application.
4. Considering the overall facts and circumstances of the present case; as also the undertaking of the learned counsel on behalf of the petitioner that the petitioner shall appear on each and every date as fixed by the learned Trial Court. Without expressing any opinion on merits/demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
5. Therefore, this bail application under Section 483 of BNSS is allowed and accused-petitioner - Shankar @ Shankar Soran S/o Jnshilal is ordered to be released on bail provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so.
