Side) 1 https://www.mhc.tn.gov.in/judis CRL MP No. 11496 of 2026 ORDER This Criminal Miscellaneous Petition has been filed seeking modification of the condition imposed in paragraph No.6(iii) of the order dated 12.06.2026 passed in Crl.MP.No.1769 of 2026 in Crl.A.No.117 of 2026. 2. The petitioners/Accused in C.C.No.5 of 2006 was convicted by the trial Court, vide judgment dated 19.12.2025. Aggrieved by the said judgement, the petitioner preferred Crl.A.No.117 of 2026 along with Crl.M.P.No.1769 of 2026 seeking suspension of sentence. This Court, by order dated 12.06.2026, suspended the sentence and enlarged the petitioner on bail, subject to certain conditions. One of the conditions imposed was that the petitioners/appellants shall surrender their Passports and Aadhaar Cards before the Learned Special Judge of Trial Court. The present petition has been filed seeking modification of the said condition. 3. The learned counsel for the petitioners submitted that the 3rd petitioner does not possess a passport, and therefore, she is unable to surrender the same before the Learned Special Judge of Trial Court. Hence, the petitioners seeks appropriate modification of the order passed in Crl.M.P.No.1769 of 2026 in Crl.A.No.117 of 2026, dated 12.06.2026. 2 https://www.mhc.tn.gov.in/judis CRL MP No. 11496 of 2026 4. Heard the learned counsel on either side and perused the materials available on record. 5. In view of the above submission made by the learned counsel for the petitioner and considering the fact that the 3rd petitioner does not possess a Passport, this Court directs the 3rd petitioner to file an affidavit before the learned Special Judge under the Tamil Nadu Protection of Interests of Depositors (in Financial Establishment) Act, 1997, Chennai, at the time of executing sureties, stating that she does not possess a Passport, and the same shall be accepted. The other conditions imposed in the order dated 12.06.2026 shall remain unaltered. 6.
