JUSTICE CHILLAKUR SUMALATHA - 3 - HC-KAR NC: 2026:KHC:6354 WP No. 482 of 2026 ORAL ORDER Heard Sri.Sridhara.K learned counsel for the petitioner. 2. Having heard learned counsel for the petitioner and on going through the entire material that is brought on record meticulously, this Court is of the view that the writ petition can be disposed of without service of notice to respondent. Hence, notice to respondent is dispensed with. 3. Seeking the Court to issue a writ of certiorari or any other appropriate writ and to quash or modify the order that is rendered by the Court of III Additional Principal Judge, Family Court, Bengaluru (wrongly mentioned as Court of II Additional Principal Judge, Family Court, Bengaluru in prayer portion of writ petition) on I.A.No.II in G & WC No.67/2025 dated 18.09.2025, petitioner is before this Court. - 4 - HC-KAR NC: 2026:KHC:6354 WP No. 482 of 2026 4. Learned counsel for the petitioner submits that petitioner is the husband of respondent. They gave birth to a female child by name Grisha Yashika. The said child is aged around 5 years at present. The child is in custody of respondent. Petitioner has got abundant love and affection towards his child and he intends to take care of the child and attend her all necessities. Respondent's brother is a drug addict and is involved in several NDPS cases. It will not be safe for the child to live with respondent and her brother. Therefore, petitioner filed an interlocutory application seeking interim custody and visitation rights of his daughter. Petitioner prayed for 50% of the custody during all vacation, festivals and birthday of the child. He also sought for interim custody from Friday evening till Monday morning every week. But the Court did not grant the relief to the extent claimed and therefore, this writ petition is filed. Learned counsel also submits that allowing the writ petition, the relief sought for may be granted. - 5 - HC-KAR NC: 2026:KHC:6354 WP No. 482 of 2026 5. Family Court through the impugned order permitted petitioner herein to pick up the child from the house of respondent at 08.00 a.m. on every second Saturday and drop the child at 06.00 p.m. on Sunday by keeping the child with him overnight on Saturday. Petitioner was also granted interim custody of the child for first 3 days in Dasara vacation, Christmas vacation and Summer vacation. Having considered the totality of facts and circumstances of the case and by giving anxious consideration to the submission made by both the learned counsel, Family Court passed such an order. This Court does not find any infirmity in the order passed and grounds for interference. Interim custody granted through the impugned order is on proper lines. Therefore, this Court is of the view that there are no merits in this writ petition. Resultantly, the following: ORDER (i) Writ petition is dismissed. - 6 - HC-KAR NC: 2026:KHC:6354 WP No. 482 of 2026 (ii) As writ petition is disposed of without service of notice to respondent, to give notice to respondent about filing of writ petition by petitioner and its disposal, Family Court is directed to serve a copy of the order of this writ petition either to respondent or her counsel.
