JUSTICE M.NAGAPRASANNA ORAL ORDER The petition is preferred on the score that the concerned Court has not permitted deposit of the 20% amount as it is being deposited after a long delay. 2. The petitioner is the accused who gets convicted of the offence under Section 138 of the Negotiable Instruments Act, files an appeal before the First Appellate Court and seeks suspension of sentence. The suspension of sentence is conditioned upon deposit of 20% amount. The said deposit is not made within time. The petitioner is now ready with the demand draft of the deposit to be made before the concerned Court. The order of the concerned Court does not reflect total application of fine for directing deposit as is observed by the Apex Court in the case of Jamboo Bhandari v. M.P.State Industrial - 3 - HC-KAR NC: 2026:KHC:3096 CRL.P No. 315 of 2026 Development Corporation Limited and others [2023 (10) SCC 446]. 3. In that light, the order is rendered unsustainable. Even otherwise, the petitioner is now ready to deposit the same within one week from today. The petitioner shall deposit before the concerned Court within one week from today. 4. In the light of the said submission that he would deposit the order of the concerned Court though unsustainable is not interfered with.
