Petitioner. Mr. Uday Sankar Chattopadhyay, Adv., Ms. Sadia Parveen, Adv. … For the Petitioner. Mr. Subhabrata Chowdhury, Adv., Mr. Saswata Chatterjee, Adv. … For the State. 1. Apprehending arrest in connection with Ketugram Police Station Case No.515 of 2026 dated 21-08-2026, the petitioner has come up before this Court. A political rivalry is apparent from the materials available. Several other criminal cases have been filed against the present petitioner since after the change of regime, which have been initiated from June, 2026 onwards. 2. Learned advocate representing the petitioner submits that in all the cases, the petitioner is enjoying bail. The allegation prima facie is of the year 2021 and no prior complaint can be found. 2 3. On behalf of the prosecution, objection has been raised to the prayer for anticipatory bail, as there are antecedents of the present petitioner. 4. Having heard the submission of the learned advocates for the parties and considering the facts and circumstances of the case and the materials on record and in absence of any specific role attributed by the present petitioner in terms of the complaint, this Court is of the opinion that the petitioner is entitled to an order of anticipatory bail, as prayed for. 5. Accordingly, in the event of arrest, the petitioner, namely, Mir Roswan Ali @ Ripon, shall be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand), with two sureties of Rs.10,000/- (Rupees Ten Thousand) each, one of whom must be local, to the satisfaction of the Arresting Officer. The petitioner shall abide by the conditions laid down in Section 482(2) of the BNSS. Further, the petitioner shall appear before the Investigating Officer once in a week, until further orders, and shall also cooperate with the investing agency. 6. In the event the petitioner failed to adhere to any of the conditions stipulated above, the learned court will be at liberty to cancel the anticipatory bail without further reference of this Court. 7. The application for anticipatory bail is, thus, allowed. 8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 3 9. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. [Chaitali Chatterjee (Das), J.]
