Smt. Sucharita Debnath Versus The State of West Bengal & Ors. Mr. Sami-ul-Bari …..for the appellant Mr. Debapriya Gupta, A.G.P., Ms. Mousumi Roy, Mr. Vaibhav Prakash, Mr. Biswanath Banerjee … for the State respondents Affidavit-of-service, as filed, be kept on record. The present appeal has been preferred challenging an order dated 11th December, 2025 passed by the learned single Judge in a writ petition being WPA 28237 of 2025. In connection with the said appeal, an application for condonation of delay being IA No. CAN 1 of 2026, has been filed. Upon hearing the learned advocates appearing for the respective parties and considering the materials on record, we are satisfied with the explanation given towards the delay in preferring the appeal. Accordingly, such delay is condoned and the said application being IA No.CAN 1 of 2026 is disposed of. With the consent of the parties, the appeal and the application for stay are taken up for hearing.
Mr. Bari, learned advocate appearing for the appellant submits that during pendency of the present appeal, the West Bengal Central School Service Commission has published a revised preliminary list of candidates for interview for selection to the posts of Assistant Teachers in c/w 2nd SLST (AT), 2025 (Classes XI-XII). The appellant’s name features in the said revised preliminary list. Let the notice dated 28th September, 2026 along with the revised list, as produced, be kept on record. Copies of the said documents have been handed over to Mr. Gupta, learned Additional Government Pleader appearing for the State respondents. In view thereof, Mr. Bari submits that the appellant does not want to proceed with the appeal as the same has become infructuous. The appeal and the connected application for stay and/or appropriate order are, accordingly, dismissed as ‘infructuous’. There shall, however, be no order as to costs. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities. (Partha Pratim Roy, J.) (Tapabrata Chakraborty, J.) 2
