Page No.# 2/3 BEFORE HONOURABLE MR. JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 22.04.2026 Heard Mr. S.M. Abdullah P, learned counsel for the petitioner. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor appearing for the State of Assam and Mr. S.K. Chakma, learned counsel for the respondent No.2/informant. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner, Aayan Ahmed has prayed for releasing him on bail after he was arrested in connection with Dispur P.S. Case No.111/2026 registered under Sections 64 of the BNS, 2023 read with Section 6 of the POCSO Act, 2012. 3. As per the FIR, the victim, who is aged about 17 years used to attend tuition classes at the residence of the mother of the present petitioner and at that place the present petitioner induced the victim to entered into a relationship with the petitioner and as a result of which she became pregnant. 4. Case Diary as called for has been received. 5. The statement of the victim girl recorded under Section 183 BNSS before the Magistrate indicates that the victim, who was aged about 17 years was in a love relationship with the petitioner, who is aged about 22 years and in course of such relationship they established physical relationship leading to pregnancy of the victim. 6. The investigation of the case appears to be almost completed and is pending for the Medical Report. And meanwhile the petitioner has spent 53 days
Page No.# 3/3 behind the bars. 7. Having regard to the facts and circumstances of the present case, it appears that further detention of the petitioner may not be warranted. Accordingly, the prayer for bail is allowed. Mr.
Aayan Ahmed is directed to be released on bail of ₹50,000/- (Rupees fifty thousand) only with two sureties of like amount to the satisfaction of the learned Special Judge, POCSO, Kamrup(M). 8. It is further provided that the petitioner shall regularly appear before the trial if once commences and shall not try to influence the witnesses in any manner. 9.
