04/ 19.03.2026 Heard learned counsel appearing for the petitioners and learned A.P.P for the State.

The petitioners are apprehending their arrest in connection with Sudamdih P.S. Case No. 56 of 2024, registered for the offence under Sections 115(2), 118(1), 117(2), 74, 109(1) and 127(1) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad.

Learned counsel appearing for the petitioners submits that the petitioners and the informant are happened to be the neighbours and they are residing in the same block of the quarter of BCCL and the quarrel has taken place for taking water from the tap. He next submits that the injury is said to be simple and further the allegation of molestation is also false in nature. He further submits that both the petitioners are own brothers.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of making assault.

Considering that the quarrel has taken place due to taking water from the tap and petitioners and informant are happened to be the

resident of the same block in the quarter of BCCL and petitioners are having no criminal antecedent and disclosure to that effect has been made in para-18 of the petition and in that view of the matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
