The revisional application has been preferred praying for transfer of ACT VIII Case no. 67 of 2026 pending in the Court of learned District Judge at Krishnanagar, Nadia to the Court of the learned Additional District Judge at Kalyani, Nadia. 4. It is the case of the petitioner/husband/father that he resides with his minor child at A-2, Kalyani Township, Post Office and Police Station-Kalyani, Dist-Nadia, Pin-741235 (child’s ordinary place of residence). 5. The mother/wife/opposite party is a resident of B- 7/121, Kalyani Township, Post Office and Police Station-Kalyani, Dist-Nadia, Pin-741235 and has filed the Misc. Case at Krishnanaga, though she too resides at Kalyani. 6. Considering the ordinary place of residence of the child and relying upon this Court’s judgments in 2 CO 4128 of 2024, Shantilal Sharma v. Susant Vyas @ Sushanta Vyas & Ors., directs that Misc. case (ACT VIII) no.67 of 2026 be withdrawn from the Court of learned District Judge at Krishnanagar, Nadia and transferred to the Court of learned Additional District Judge at Kalyani, Nadia. 7. The learned Additional District Judge at Kalyani, Nadia shall proceed with the Misc Act VIII case in accordance with law with due notice upon both the parties. 8. CO 3215 of 2026 stands disposed of. 9. Parties to act on the server copy of this order. 10. Let a copy of this order be sent to the concerned Courts for immediate compliance. (Shampa Dutt (Paul), J.)
