Mandal Ms. Maitree Ray Ms. Udita Mandal ….for the respondents Mr. Chandan Roy …….for the respondent no. 8 1) Affidavit of service filed on behalf of the petitioner is taken on record. 2) Matter is heard in presence of learned advocates representing the petitioner, respondent no. 8 and NTPC Limited. 3) It appears that husband of the petitioner was an employee of NTPC Limited and due to his death benefits are payable to the petitioner being wife and respondent no. 8 being son of the deceased employee. 4) However, it has been pointed out by Mr. Majumder, learned Senior Advocate representing NTPC Limited that pension under 2 NTPC Defined Contribution Pension Scheme and benefits under NTPC Post Retirement Medical Scheme are payable only to the petitioner not others. Court is also apprised on behalf of NTPC Limited that steps are being taken for early disbursal of pension under NTPC Defined Contribution Pension Scheme. 5) Concerned authority of NTPC Limited is directed to take all necessary steps for release of pension under NTPC Defined Contribution Pension Scheme and same shall be released with cooperation of Life Insurance Corporation of India (LIC) by four weeks from date of communication of this order. Benefits under Post Retirement Medical Scheme shall also be extended to the petitioner as per requirement. 6) On hearing the learned advocates representing the parties including the learned advocate representing the respondent no. 8 who appears online, it is found that other benefits namely Provident Fund, gratuity and leave encashment are to be released proportionately to the petitioner and respondent no.8. 7) Hence, concerned authority of NTPC Limited is directed to release those benefits as per paragraph 10 of the report which was 3 affirmed on behalf of NTPC Limited on 11th December, 2025 to the petitioner and respondent no. 8 on compliance of necessary formalities at an early date but not later than twelve weeks from date of communication of this order. 8) Writ petition stands disposed of. 9) There shall be, however, no order as to costs. 10) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
