For Petitioner(s): Mr.T.Dharani For Respondent(s): Mr.A.R.Balaji, Government Advocate https://www.mhc.tn.gov.in/judis WP No. 24041 of 2026 __________ Page2 of 4 ORDER The writ petition is filed for the relief set out below: "directing the 1st respondent to consider the petitioner’s representation 28.01.2026 to declare petitioner probation in the post of Junior Assistant with effect from 22.05.1988 within limited time frame." 2. It is the case of the petitioner that he was appointed as Junior Assistant on compassionate grounds on 30.04.1986 in the Tamil Nadu Forest Department and he was regularized with effect from 30.04.1986. After regularization, the petitioner sought to undergo the training which he was unable to attend due to medical condition, later, completed the training. The petitioner had availed 22 days of leave during probation period. The delay in training completion is solely due to his bona fide medical condition and not on account of any fault or negligence. Therefore, the petitioner is eligible for the consequential declaration of probation which was not yet declared. 3. Aggrieved by the same, the petitioner made several representation including representations dated 15.04.2024 and 28.01.2026 for which there is no response till date. Heard the learned counsel on either side and perused the materials available on record. 5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner's representation dated 28.01.2026, on merits and in the light of proposal in Na.Ka.No.N1/28366/2020 dated 10.07.2021 and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of.
