For Petitioner(s): Mr.K.Saravanan For Respondent(s): Mr.L.Gokulraj, Government Advocate for R1-3 ORDER The writ petition is filed for the relief set out below: "directing the 1st and 2nd respondents to consider and conduct enquiry on the petitioner’s representation dated 21.04.2026, complaining for promotion granted to the 4th respondent as B.T.Assistant (Mathematics) by overlooking merit and seniority of the Petitioner, contrary to Rule 15(4) of the Tamil Nadu Recognised Private Schools (Regulation) Rules, 1974." 2. It is the case of the petitioner that he was appointed as Secondary Grade Teacher on 11.04.2001 in the third respondent school. While so, in the year 2015, there arose a vacancy for the post of B.T.Assistant (Mathematics). Though the petitioner was fully qualified and senior most eligible teacher in the feeder category for the said post, the third respondent overlooked the petitioner’s seniority and promoted the fourth respondent to the said post which is contrary to the Rule 15(4) of the Tamil Nadu Recognised Private Schools (Regulation) Rules, 1974. https://www.mhc.tn.gov.in/judis WP No. 23937 of 2026 __________ Page3 of 4 3. Aggrieved by the same, the petitioner made a representation dated 21.04.2026 before the first and second respondents for which there is no response till date. Therefore, the petitioner is before this Court. 4. Heard the learned counsel on either side and perused the materials available on record. 5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 21.04.2026, on merits and in accordance with law and to pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order. It is needless to state that this Court has passed this order without issuing notice to the fourth respondent only on account of the fact that the second respondent is directed to issue notice to the fourth respondent and only after hearing him, shall pass orders thereafter on the petitioner’s representation dated 21.04.2026. With the above directions, the writ petition is disposed of.
