The petitioner is apprehending his arrest in connection with Complaint Case No.2109 of 2023, for offence registered under sections 26(1)(g), 41, 42 and 52 of Indian Forest Act, 1927 (Bihar Amendment Act, 1989), Sections 27, 29 and 51 of Wild Life Protection Act, pending in court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel for petitioner submits that the allegation is made of loading 250 kg of mica scrap on the Tempo and the name of the petitioner has come only on suspicion. He further submits that the petitioner is neither the owner nor the driver of the said Tempo and the petitioner earns his livelihood by way of doing labour work and the petitioner has got no criminal antecedent as disclosed in paragraph no.13 of the petition. 4. Learned State counsel opposes prayer and submits that the 2026:JHHC:1095 2 allegations are there of carrying scrap mica on the Tempo. 5. Considering that the petitioner is neither the owner nor the driver of the said Tempo and it has been pointed out that the petitioner is earning his livelihood by way of doing labour work and further the petitioner has got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Complaint Case No.2109 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
