Also heard Mr. P. S. Lahkar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PR Case No.711/2024, pending in the Court of the learned Judicial Magistrate First Class, Sonitpur, Tezpur. 3. The petitioner, Jinnatul Islam @ Md. Jinnatul Islam has been shown as an absconder in the Charge-Sheet. The learned Judicial Magistrate First Class, Sonitpur Page No.# 2/2 has directed issue of summons against him. The petitioner apprehends that since the offence alleged against him are triable by the Court of Sessions he shall not be released on bail by the learned Judicial Magistrate First Class, Sonitpur, Tezpur. The petitioner submits that if he is interested in facing the trial and, therefore, he deserves to be given an adequate opportunity to that effect. 4. I have considered the submissions made by the learned counsel for both sides. 5. This Court is of the opinion that since the petitioner is interested in facing the trial he deserves to be given an adequate opportunity to that effect. Therefore, the prayer of the petitioner is allowed. 6. It is hereby directed that the petitioner, Jinnatul Islam @ Md. Jinnatul Islam is directed to appear before the learned Judicial Magistrate First Class, Sonitpur, Tezpur in connection with PR Case No.711/2024 within a period of 7 (seven) days from today and on his appearance, he shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the by learned Judicial Magistrate First Class, Sonitpur, Tezpur. 7.
