After submitting for a brief while, learned counsel for petitioners would request leave of this Court to approach the Banking Ombudsman to seeks redressal of his grievance. While agreeing with the above submission, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, it is open to petitioners to submit a representation/complaint before the Reserve Bank – Integrated Ombudsman Scheme (RB-IOS) along with documentary evidence.
If any such representation/complaint is submitted by petitioners, the same shall be considered without reference to limitation by the Banking Ombudsman Authority, on its own merits and orders shall be passed in accordance with law, after affording reasonable opportunity of hearing to petitioners, second respondent and any other interested parties within a period of three (3) weeks from the date of such representation/complaint filed before the Reserve Bank – Integrated Ombudsman Scheme (RB-IOS). It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law. 4. Accordingly, the writ petition stands disposed of. Consequently connected miscellaneous petition is closed.
