JUSTICE ASHOK KUMAR JAIN Order 08/04/2026 This writ petition has been filed by the petitioners with the following prayers:- “It is, therefore prayed that the present D.B. Civil Writ Petition filed by the petitioner may kindly be accepted and allowed while also directing the respondents that: a) Issue an appropriate writ, order or direction quashing and setting aside the impugned order dated 10.02.2026 passed by the learned Central Administrative Tribunal, Jaipur Bench in M.A. No. 71/2026 in O.A. No. 696/2025, whereby the learned Tribunal has illegally declined interim relief and upheld the arbitrary ineligibility of the petitioners; b) Direct the respondents to undertake the Computer ‘Based Test of the petitioners in furtherance of the Notification dated 30.07.2025 for the post of Goods Train Manager. c) Declare that the eligibility condition imposed vide Notification dated 30.07. 2025, requiring completion of three years’ service in Pay Matrix Level-2 to Level-4 as on the date of notification, is contrary to Master Circular No.31 of the Railway Board, ultra vires, arbitrary, unconstitutional and unenforceable in law; d) Issue a writ of mandamus directing the respondents to redraw and revise the [2026:RJ-JP:14507-DB] (3 of 3) [CW-5079/2026] eligibility list dated 12.09.2025 strictly in accordance with Master Circular No.31 by treating the petitioners as eligible candidates for promotion to the post of Goods Train Manager (Pay Matrix Level-5); e) Pass such further or other order(s) as this Hon’ble Court may deem fit, just and proper in the facts and circumstances of the case, in the interest of justice. Admittedly, the dispute pertains to promotion to the post of Goods Train Manager. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court is not inclined to interfere with the impugned order at this stage. However, in the interest of justice, the present writ petition is disposed of with the direction that any promotion made during the pendency of the Original Application before the learned Central Administrative Tribunal shall remain subject to the final outcome of the said Original Application.
