And In the matter of : Sandipan Pramanik
……Petitioner. Mr. Malay Bhattacharyya
.....for the Petitioner. Mr. Gouranga Kumar Das, Ld. APP Ms. Nabanita Chatterjee
……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about four months, charge-sheet has already been submitted before the jurisdictional Court. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the statement of the victim. I have taken into account the statement of the victim under Section 183 of the BNSS. I have also taken into account the materials on which the prosecution has relied upon in the charge-sheet. Having regard to the overall circumstances of the case, I am of the opinion that custodial detention of the present petitioner is unwarranted. Accordingly, prayer for bail of the petitioner is allowed. As such, the petitioner, namely, Sandipan Pramanik shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten
2 Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Purba Bardhaman. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Purba Bardhaman without prior permission of the learned Trial Court. Additionally, petitioner shall meet with the Officer-in-Charge of Ausgram Police Station once in a week till the vulnerable witnesses are completed by the prosecution. The attendance must be furnished on the fixed date before the learned jurisdictional Court. Any violation of the conditions will lead to cancellation of bail by the learned jurisdictional Court without further reference to this Court. Thus, CRM (M) No. 2011 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Memo of evidence submitted by the State be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
