For Petitioner(s): Mr.P.M.Jayachandran For Respondent(s): Mr.R.S.Indira, GOVT.ADVOCATE (CRL.SIDE) https://www.mhc.tn.gov.in/judis CRL OP No. 15763 of 2026 __________ Page2 of 6 ORDER The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 318(4), 351(2) BNS Act, r/w 66-D ITA-2000-2008 in Crime No.76 of 2025, on the file of the respondent Police, seeks anticipatory bail. 2. The case of the prosecution is that the defacto complainant, one Pateela Janardhan Reddy, received a phone call from unknown person by digital with criminal intimidation. The caller threatened him digitally and caused criminal intimidation. Thereby, the defacto complainant transferred the amount to Karur Vysya Bank account through RTGS. Later, the defacto complainant came to know that he had been cheated by the unknown accused person. 3.Based on the complaint, the 1st respondent investigated the case and found that the alleged amount was credited in the Ezhumalaiyan Chit Funds Private Limited which was run by one Sivaperumal. He gave a statement that one Sureshkumar had introduced the defacto complainant for getting loan and had collected the bank passbook and other documents of the defacto complainant. https://www.mhc.tn.gov.in/judis CRL OP No. 15763 of 2026 __________ Page3 of 6 4.The petitioner is working as an auditor. The accused persons namely, Sureshkumar and Sivaperumal are clients of the petitioner. Since the petitioner is known to the accused persons, the petitioner has been called to appear before the first respondent police. 5.The learned counsel for the petitioner would submit that the police from Andhra Pradesh State have come to the petitioner's premises on the pretext of pendency of an FIR in Crime No.76 of 2025. It is the contention of the petitioner that he is a local resident of Dharmapuri and has no relatives at Andhra Pradesh. Therefore, to have an effective remedy, he would be required to go to Andhra Pradesh for engaging an Advocate. It is further submitted that in the interregnum, if the petitioner is remanded, his right to seek legal remedy would be jeopardised. Hence, prayed to enlarge him on interstate anticipatory Bail. 6.The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and strongly opposed to grant anticipatory bail to the petitioner. 7.From the materials placed before this Court, it is seen that the petitioner is a resident of the State of Tamil Nadu, whereas the FIR has been registered in the State of Andhra Pradesh. Considering the submission that the https://www.mhc.tn.gov.in/judis CRL OP No. 15763 of 2026 __________ Page4 of 6 petitioner has no roots in Andhra Pradesh and requires reasonable time to approach the competent Court there for appropriate relief, this Court is of the view that it is appropriate to grant interstate anticipatory bail to the petitioner for a period of four weeks. 8. Accordingly, interim interstate anticipatory bail is granted to the petitioner subject to the following conditions: (i) The petitioner shall surrender before the learned Judicial Magistrate Court - I, Dharmapuri, within seven(7) days from the date of receipt of copy of this order; (ii) On such surrender, he shall be enlarged on bail on condition that he shall execute a bond for Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each for a like sum to the satisfaction of the said Magistrate. (iii) Within four weeks of such surrender before the above said Magistrate, the petitioner shall seeks appropriate relief before any of the jurisdictional Courts in the State of Andhra Pradesh.
