Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC No.248/2025, pending in the Court of the learned Page No.# 2/2 Judicial Magistrate First Class, South Salmara, Mankachar. 3. The petitioner, Sahinur Islam has been shown as an absconder in the Charge-Sheet alleging commission of offence under Section 310(2) of the BNS. The petitioner now submits that he wants to contest the case and, therefore, prayed for some opportunity to that effect. The petitioner submits that since he has been shown as an absconder in the Charge-Sheet, he will be remanded to custody if he appears before the Court below on his own. 4. I have considered the submissions made by the learned counsel for both sides and I have also gone through the record. 5. This Court is of the opinion that since the petitioner is interested in facing the trial he deserves to be given an adequate opportunity to that effect. Therefore, the prayer of the petitioner is allowed. 6. It is hereby directed that the petitioner, Sahinur Islam is directed to appear before the Trial Court of the learned Judicial Magistrate First Class, South Salmara, Mankachar in connection with PRC No.248/2025 within a period of 7 (seven) days from today and on his appearance, the petitioner shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Judicial Magistrate First Class, South Salmara, Mankachar. 7.
