The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No.28 of 2025 of Podalakur Police Station, SPSR Nellore District, registered against the Petitioner/Accused herein for the offences punishable under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS). 2. Smt. Kopparthi Sumathi, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Therefore, he prays that the present petition be allowed. 3. Per contra, Mr.K.Sandeep, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner and submitted that though the charge sheet has already been filed in the case, the accusations against the petitioner are well founded. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, this is the third bail application filed by the petitioner/Accused. A Coordinate Bench of this Court, in Crl.P.No.2392 of 2026, by order dated 07.04.2026, dismissed the second bail application filed by the petitioner.
However, the learned Trial Court was directed to proceed with the trial and dispose of the case as expeditiously as possible, and to submit a report to the Registrar (Judicial) by 07.05.2026, inasmuch as the petitioner has been in judicial custody since 07.03.2025. The learned counsel for the petitioner submits that there has not been much progress in the trial and that the case is now coming up for fixing the schedule, and is listed on 06.08.2026. The petitioner is the sole accused against whom serious allegations are levelled that he murdered an unknown male beggar. 6. Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the petitioner, and in view of the fact that there is no change in the circumstances from the date of dismissal of the second bail application till the filing of the present (third) bail application, this Court is not inclined to enlarge the petitioner/Accused on bail at this juncture. Accordingly, the Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed. 4 Dr.YLR,J Crl.P.No.5088 of 2026 Dated 01.07.2026
