The present petition has been filed for following reliefs: “WHEREFORE, the petitioner herein humbly prays that this Hon'ble Court be pleased to call for records in LGC(P) No.1441/2017 on the file of the Hon'ble Special Court for Prohibition of Land Grabbing, Kandaya Bhavan, Bengaluru, hear the parties and pass the following orders. a) Issue a writ in the nature of Certiorari or any other appropriate writ or order to quash the proceedings in Case No.LGC(P) No.1441/2017, pending on the file of the Hon'ble Special Court for Prohibition of Land Grabbing, Kandaya Bhavan, Bengaluru vide ANNEXURE-G. b) Issue a writ in the nature of Certiorari or any other appropriate writ or order to quash the orders dated 7.11.2018 in Case No.LGC(P) No.1441/2017 passed by the Hon'ble Special Court for Prohibition of Land Grabbing, Kandaya Bhavan, Bengaluru vide ANNEXURE-G. c) To declare that, the Karnataka Land Grabbing Prohibition Act, 2011 (Karnataka Act No.38 of 2014) is ultra virus to the Constitution of India, being violating of Articles No.14, 20, 21 & 300-A or in the alternative. d) To issue a writ, declaring that, the Karnataka land grabbing Prohibition Act, 2011 (Karnataka Act 38 of 2014) is not applicable to the facts and circumstances of the case of the petitioner. e) To issue any other appropriate writ or order direction as this Hon'ble Court deems fit to pass, in the interest of justice and equity.” - 4 - HC-KAR NC: 2026:KHC:2532-DB WP No. 352 of 2020 2. After some arguments, the learned counsel for the petitioner submits that he would like to withdraw this petition and approach the Land Grabbing Court for discharge in case No.LGC(P) No.1441/2017 inasmuch as charge has not been framed in the said case. 3. Considering the aforesaid submission, we dispose of this petition with liberty to the petitioner to approach the concerned Court for discharge by moving an appropriate application and if such an application is moved, learned Land Grabbing Court to consider the application in accordance with the law expeditiously.
