Versus The State of West Bengal Ms. Shabana Hasin Ms. Samima Akter. …for the petitioners. Mr. Avishek Sinha Mr. Dattatreya Dutta. …for the State. Learned advocate appearing for the petitioners submits that the petitioners along with another were implicated for alleged recovery of 31.4 kgs. of ganja and are in custody for six months. It has also been contended that since the charge-sheet has already been submitted, petitioners may be released on bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and submits that the petitioners are thickly connected with the offence. I find that the seizure is of commercial quantity and the rigors of Section 37 of the NDPS Act is attracted. As such, the prayer for bail in CRM (NDPS) 88 of 2026 is rejected.
