Learned advocate appearing for the petitioner submits that petitioner is in custody for about three years six months and the trial of the case has till date not been concluded, thereby resulting the petitioner languishing in jail unnecessarily. Learned advocate for the State submits that out of 26 witnesses cited by the prosecution 23 witnesses have already examined. The evidence of the investigating officer and two nodal officers are left to be examined. Having regard to the advance stage of the case, I am not inclined to release the petitioner on bail. However, the learned trial Court would ensure that the evidence of the three witnesses are concluded within a period of three months from the next date of the learned trial Court resuming office. 2 With the aforesaid observations CRM (M) 569 of 2026 is dismissed. State is directed to communicate this order to the learned trial Court. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
