I have heard the learned counsel for the petitioner and the Government Advocate appearing for the respondent. 3. The gravamen of the allegations contained in the final report is that the petitioner conducted a chit and thereafter did not pay the amount due to one of subscribers to the chit. Hence, the case. 4. The contention of the learned counsel for the petitioner is that the petitioner has duly and faithfully paid the amount due to the defacto complainant. But, since there was a delay the defacto complainant initially claimed only interest, now later on makes false claims as if the amount itself is not paid. 5. From the very arguments of the learned counsel for the petitioner it can be seen that these are factual aspects which cannot be incontrovertibly decided by this Court in exercise of power under section 482 of Criminal procedure code. https://www.mhc.tn.gov.in/judis CRL OP No. 16848 of 2026 __________ Page3 of 4 6. In view thereof, keeping open the liberty of the petitioner to raise all grounds before the Trial Court, this Criminal Original petition stands disposed of.
