JUSTICE ANJAN MONI KALITA ORDER 22.04.2026 [1] Heard Mr. N.N.B. Choudhury, the learned counsel for the petitioners. Also heard Mr. M.M. Zaman, the learned counsel appearing on behalf of Mr. S. Chamaria, the learned Standing Counsel, Assam Seeds Corporation Ltd. appearing for the respondent Nos. 4 and 5 as well as Ms. G. Bora, the learned Standing Counsel, Agriculture Department appearing for the respondent Nos. 1,3,6 and 7. [2] The case of the petitioners is that the petitioner No. 1 has supplied Hybrid vegetable seeds of certain crops like Cauliflower, Page No.# 3/4 Cabbage, Tomato, Brinjal and Chilli in various quantities to the Assam Seeds Corporation Ltd., Jorhat. However, the bills for the aforesaid supplier were not paid to the petitioner No. 1 in spite of repeated request made to the concerned authorities. [3] It is submitted by the learned counsel appearing for the respondent Nos. 4 and 5 that an affidavit-in-opposition has already been filed on 21.04.2026. However, the same is not tagged with the record. [4] Therefore, while hearing the matter, he has produced a copy of the affidavit-in-opposition which has been kept on record and marked as Annexure- ‘X’. [5] Ms. G. Bora, learned Standing Counsel, Agriculture Department has also submitted a communication issued to her by the Directorate of Agriculture, Assam which is marked as ‘Y’ and kept on record. [6] From the affidavit-in-opposition as well as the communication issued by the Directorate of Agriculture dated 17.03.2026, it is revealed that the amount, i.e. Rs. 3,52,991,42/- (Rupees Three Lakhs Fifty Two Thousand Nine Hundred and Ninety One and Forty Two Paisa) is an admitted amount, which is liable to be paid by the aforesaid Assam Seeds Corporation Ltd. to the petitioners. [7] From the aforesaid communication dated 17.03.2026, it is revealed that the sanction of the amount for budget requisition has Page No.# 4/4 to be made in the present financial year. Since the amount is admitted by the Agriculture Department as well as Assam Seeds Corporation Ltd., this court is of the considered opinion that this instant writ petition can be disposed of with a direction to the concerned authority, i.e., Assam Seeds Corporation Ltd., Jorhat to release the aforesaid amount of Rs. 3,52,991.42/- (Rupees Three Lakhs Fifty Two Thousand Nine Hundred and Ninety One and Forty Two Paisa) to the petitioners after receipt of the certified copy of this order within a period of 1(one) month. [8] The petitioners shall produce the certified copy of the instant order before the concerned authority for the needful as early as possible. JUDGE Comparing Assistant
