David Government Counsel for R1 to R3 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus forbearing the 3rd respondent from registering any document in respect of the properties comprised in Survey Nos.21 and 22/3, measuring an extent of 10,469 sq.ft., 9,555 sq.ft., and 4,800 sq.ft., situated at Palavakkam Village, Neelangarai Taluk, Chengalpattu District, pending disposal of the __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 24886 of 2026 Protest Petition dated 12.03.2026, registered as Document No.PP/Neelangarai/16/2026 on the file of the 3rd respondent. 2. The learned Senior Counsel appearing for the petitioner submitted that respondent Nos.4 and 5 are making attempts to alienate and register documents in respect of the petitioner's property comprised in the aforesaid survey numbers and extents. Apprehending such illegal registration, the petitioner submitted a Protest Petition dated 12.03.2026 requesting the 3rd respondent to issue notice to the petitioner and afford an opportunity of hearing before entertaining or registering any document relating to the subject property. Since no action has been taken on the said Protest Petition till date, the petitioner has been constrained to invoke the extraordinary jurisdiction of this Court by filing the present Writ Petition. 3. The learned Government Counsel appearing for respondent Nos.1 to 3 fairly submitted that, in the event any document relating to the subject property is presented for registration, the 3rd respondent shall consider the petitioner's objections, issue notice to all necessary parties, afford them an opportunity of personal hearing, and pass appropriate orders in accordance with law before proceeding further. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 24886 of 2026 4. In view of the above submission, the 3rd respondent is directed to consider the petitioner's Protest Petition, taking note of her claim of ownership over the property comprised in Survey Nos.21 and 22/3 situated at Palavakkam Village, Neelangarai Taluk, Chengalpattu District. Before registering any document relating to the subject property, the 3rd respondent shall issue notice to the petitioner, respondent Nos.4 and 5, and all other necessary parties, afford them an opportunity of personal hearing, and thereafter pass appropriate orders in accordance with law on the Protest Petition, if any document is presented for registration. 5. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 06-07-2026 Asi To 1.
