This is the first bail application filed u/s 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.652/2025 registered at Police Station Kasdol, District Balodabazar- Bhatapara (CG) for the offence punishable under Sections 296, 115(2), 351(3), 103(1), 3(5) of BNS. 2. 2 matter to the concerned police station, stating that on 26.10.2025 at about 8:25 pm, the deceased, after consuming liquor, was using filthy language towards his wife. At that time, the applicant came there and asked why he was using filthy language in front of elderly people. Thereafter, the applicant allegedly used obscene language, threatened him with dire consequences, and assaulted him with his hands and fists. The applicant also abused the complainant, who intervened in the matter. The deceased was taken to the hospital, and on 27.10.2026, the deceased died during the course of treatment. Based on this, offence has been registered against the present applicant. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case on the basis of the complainant’s statement. Initially, on the report of the complainant, an FIR was registered under the bailable offences. However, at the time or recording the statement under Section 180 of BNSS, the complainant allegedly developed the facts, and thereafter Sections 103(1) and 3(5) of the BNS were added by the police. As per the MLC application dated 26.10.2025, the deceased was allegedly beaten only by hands and fists. In the MLC examination, no injury was found on any vital part of the body.
He further submits that in the present case, a bamboo stick has been seized from an open public place at Bhadra Road near the canal, and no blood stains were found on the alleged stick. He also submits that the applicant is in jail since 28.10.2025, the juvenile co-accused has already been granted bail by the Juvenile Justice Board on 07.01.2026, and there is no likelihood of the trial being
3 concluded at the earliest. Hence, considering all these facts, the applicant may be released on bail. 4. Learned State counsel, on the other hand, opposing the bail application, submits that as per the postmortem report, the nature of death is homicidal. There is one eyewitness, namely, Chandrika, in the matter. Trial has not commenced yet. Therefore, considering the nature of the offence, at this stage, the applicant does not deserve to be released on bail. 5. Heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the entire facts and circumstances of the case, particularly the nature and gravity of the offence and the material collected and available on record against the applicant, and further considering that the trial has not commenced yet, without commenting on the merits of the case, at this stage, this Court is not inclined to release the applicant on bail. 7. Accordingly, the present bail application stands rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
