Learned Senior advocate appearing for the petitioner submits that about 50% of the job after receiving the tender has been completed; charge-sheet has already been submitted before the learned jurisdictional court and the petitioner is in custody for about 51 days. Therefore, he prays that the petitioner may be released on bail on any stringent conditions. Learned advocate for the defacto-complainant opposes the prayer for bail and submits that there are
2 accusations of forgery against the present petitioner and other allegations like not completion of boundary wall along with gates, guard room etc for which tender has been allotted to the petitioner. Learned advocate for the State also opposes the prayer for bail and submits a report which speaks that 38% of the job has been done. Having considered the fact that charge-sheet has been submitted and 38% of the work has already been done as also the factum that so far as the other allegations leveled against the present petitioner is concerned, that is not the subject-matter of the criminal court to look at, I am inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Bikash Adhikary shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM, Chandannagar, Hooghly.
