THIS PETITION COMING ON FOR ADMISSION THIS DAY, ORDER WAS MADE THEREIN AS UNDER: Digitally signed by PADMASHREE SHEKHAR DESAI Location: High Court Of Karnatka - 2 - HC-KAR NC: 2026:KHC:1077 CP No. 6 of 2025 CORAM: HON'BLE MRS. JUSTICE P SREE SUDHA ORAL ORDER Though this matter has come up for admission, with consent of learned counsel for the parties, the same is taken up for final hearing and disposed of by this order. 2. This petition is filed by wife for transfer of divorce petition filed by husband in MC No.1251 of 2023 pending before the I Additional Principal Family Judge, Mysore to Senior Civil Judge Court/Family Court at Periyapatna as she is residing with her parents at Periyapatna. 3. The main contention of learned counsel for petitioner is that the petitioner underwent leg operation and he filed discharge summary to that effect. It is further stated that the case under Section 498 of I.P.C. is pending against them and she has also filed a case and a PVC in Mysore. As such, there is no mention of any threat. 4. Learned counsel for the respondent stated that, in the objections for the divorce petition filed by the petitioner, she has admitted that she is working in a company at Bangalore. - 3 - HC-KAR NC: 2026:KHC:1077 CP No. 6 of 2025 The distance between Mysore and Periyapatna is 40 kilometres. The learned counsel for the respondent has also filed certain documents to show that the petitioner travelled for a trip to Uttarakhand along with her friends. 5. Heard the arguments of both sides. 6. Perusal of the discharge summary shows that the petitioner underwent operation on 06.09.2022 for fracture of both bone right leg distal third. She is working in a company. Considering the fact that the petitioner underwent surgery way back in the year 2022 and also the fact that all the other cases are pending at Mysore and the distance between both the places is 40 kilometres this Court finds that there are no merits in the petition. Accordingly, the petition is dismissed. Sd/- (P SREE SUDHA) JUDGE CS CT:NR List No.: 1 Sl No.: 47
