THE MANDAL THASILDAR, ATCHAMPET MANDAL AT ATCHAMPET PALNADU DISTRICT.-522409 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in issuing through proceedings in Rc.766/2026-C dated 10.06.2026 by suspending the authorization of the petitioner as fair price shop dealer of Shop No. 0707012 of Chamarru Village Atchampet Mandal Palnadu District without issuing any show cause notice to the petitioner and without following procedure contemplated under law as illegal, arbitrary and violative of principles of natural justice and violative of Articles 14, 19 (1) (g) of the Constitution of India and also violative of Andhra Pradesh State Targeted Public Distribution System (Control) Order 2018 and consequently set aside the same by directing the respondents to continue the petitioner to hold Shop No. 0707012 of Chamarru Village Atchampet Mandal Palnadu District and to pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to continue the petitioner as F.P. shop Dealer and to supply essential commodities to the petitioner's fair Shop No. 0707012 of Chamarru Village Atchampet Mandal Palnadu District by suspending the proceedings of the 3rd respondent in Rc.766/2026-C dated 10.06.2026 pending disposal of the writ petition and to pass Counsel for the Petitioner: 1. GP FOR CIVIL SUPPLIES The Court made the following: ::ORDER :: Assailing the proceedings issued vide Rc.No.766/2026-C, dated 10.06.2026 (Ex.P1) by respondent No.3, suspending the authorisation of the petitioner in respect of Fair Price Shop No.0707012 of Chamarru Village, Atchampet Mandal, Palnadu District, without issuing any notice, as illegal and arbitrary, the above writ petition was filed. 2. At the hearing, learned counsel for the petitioner confined the arguments and urged the Court to direct the respondent No.3 to complete the inquiry within the time stipulated under Clause 8(4) of the Andhra Pradesh Targeted Public Distribution System (Control) Order, 2018 (hereinafter referred to as ‘the Order, 2018). Page 3 of 4 3. Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, did not refute the submission made by learned counsel for the petitioner. 4. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the stage of admission with the consent of learned counsel appearing on either side, with the following directions: (i) The respondent No.3 shall conclude the inquiry by supplying relevant material papers to the petitioner along with the show-cause notice. (ii) The 3rd respondent shall afford an opportunity of hearing to the petitioner and thereafter pass a reasoned order within the time stipulated under Clause 8(4) of the Order, 2018. (iii) The petitioner shall cooperate during the inquiry. (iv) If the respondent No.3 fails to conclude the inquiry within the time stipulated, the proceedings issued vide Rc.No.766/2026-C, dated 10.06.2026 (Ex.P1) by respondent No.3, suspending the authorization of the petitioner in respect of Fair Price Shop No.0707012 of Chamarru Village, Atchampet Mandal, Palnadu District, shall stand suspended, without reference to any further orders. No order as to costs.
