HON'BLE MR. JUSTICE RAVI CHIRANIA
Order 19/03/2026
1. This misc. bail application has been filed by the petitioner Mahendra Meena S/o Shri Ramkhiladi Meena, aged about 27 years in connection with the FIR bearing No.267/2025 dated 12.09.2025 registered at Police Station Gandhi Nagar, District Ajmer for the offences punishable under Sections 309(6), 331(6) of B.N.S.,
2023.
2.
Learned counsel submitted that the bail application filed by the petitioner was rejected by the Additional District & Session Judge No.1, Kishangarh District Ajmer vide order dated 03.02.2026 thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S.
3.
Learned counsel submitted that the petitioner has falsely been implicated in the present case. Learned counsel further
[2026:RJ-JP:11950] (2 of 3) [CRLMB-3403/2026] submitted that one of the co-accused persons namely Shivam has been enlarged on bail by Co-ordinate Bench of this Court passed in SBCRLMB No.14761/2025 vide order dated 09.01.2026. It is further submitted that other co-accused persons, namely Sonu Singh and Gaurav Doriya, have also been enlarged on bail by the learned Trial Court, while allowing their respective bail applications vide order dated 10.02.2026 and 12.02.2026, respectively.
Learned counsel further submitted that the accused-petitioner is the only person who has not been granted the benefit of bail on the ground that three cases are pending against the accused- petitioner, as per the bail rejection order passed by the learned Trial Court vide order dated 03.02.2026. In view thereof, learned counsel prayed that the petitioner be enlarged on bail.
4. Learned Public Prosecutor strongly opposed the bail application, however, could not refute the contention that the similarly situated persons, namely Sonu Singh and Gaurav Doriya have been enlarged on bail by the learned Trial Court.
5. This Court considered the order passed by Co-ordinate Bench of this Court in respect of the co-accused persons, as well as the
order passed by the learned Trial Court, that the charge-sheet has already been filed, trial will take sufficiently long time and after considering the overall facts and circumstances of the case, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner on bail.
7. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Mahendra Meena S/o Shri Ramkhiladi Meena shall be
[2026:RJ-JP:11950] (3 of 3) [CRLMB-3403/2026] released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage or misuse of liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
