SHAMANTH NAIK, HCGP) THIS WP IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO-QUASH THE ONLINE COPY OF THE ENDORSEMENT DATED 22.07.2025 ISSUED BY THE R2 SIGNED ON 23.07.2025 IN NO. RRT 489/2025-25 (E-742133) PRODUCED AT ANNX-D.ISSUE WRIT OF MANDAMUS TO THE R2 TO RECTIFY THE EXTENT OF LAND Digitally signed by JUANITA THEJESWINI Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2026:KHC:3765 WP No. 464 of 2026 BEARING SY. NO. 39/2 (OLD NO. 39) AS 17.08 GUNTAS INSTEAD OF 0.02 GUNTAS FORTHWITH IN THE RTC KATHA AND BY ASSIGNING MR NO. IN COMPUTERIZED RTC AND KATHA AND MUTATION REGISTER AND ETC., THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for both the respondents. 2. The grievance of the petitioner is that in terms of the sale deed dated 30.10.1980, the name of the petitioner was entered in the revenue records showing 17 ½ guntas as the extent of land in the ownership and possession of the petitioner, however, without notice to the petitioner the extent of land was reduced to 2 guntas. The petitioner is seeking a direction to the Tahsildar to consider his representation at Annexure-C. However, the Tahsildar has issued an endorsement stating that Survey No.39 was later subdivided as Survey No.30, 39/1 and 39/2. What is reflected in Survey No.39/2 is 2 guntas. Learned counsel however submits that there is no clarity as to whether the remaining extent is shown in Survey No.39 and 39/1. Moreover, the petitioner was never - 3 - HC-KAR NC: 2026:KHC:3765 WP No. 464 of 2026 informed that the property was subdivided and if such an action is taken, it is without authority of law. 3. Consequently, the writ petition stands disposed of, with a direction to the respondent – Tahsldar, Kanakpura Taluk to state correctly as to whether Survey No.39 which earlier had an extent of 17.08 guntas was subdivided and if so, when it was subdivided and what are the extent shown in Survey No.39, 39/1 and 39/2. The information shall be made available to the petitioner within a period of two weeks from the date of receipt of a copy of this order. 4. Liberty is reserved to the petitioner to question such an action taken by the Tahsildar if it was ordered without notice to the petitioner. Ordered accordingly. 5. Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE KLY
