30.09.2026 Court No.35. D/L.26. Rakib (Allowed) CRM (M) 2002 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Panchasayar Police Station Case no. 20 of 2020 dated 17.03.2020 under Sections 120B/302/324/34/212 of the Indian Penal Code. And In the matter of : Abhijit Roy @ Lal ……Petitioner. Mr. P. K. Datta Mr. Kailash Jamoli Mr. Santanu Deb Roy Mr. Manabendra Nath Bandopadhyay .....for the Petitioner. Mr. Krishnendu Bhattacharya, Ld. APP Ms. Tanusree Kar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about six years five months, 28 witnesses have been examined out of 94 witnesses proposed by the prosecution to be examined. Other accused persons have been granted bail who have been incarcerated for such a period of time. Learned advocate appearing for the State distinguishes the locus of the present petitioner in the complicity of the offence and submits that prosecution has scaled down the number of witnesses and proposes to examine 13 more witnesses. The report which has been submitted by the State do not reflect that there are other criminal antecedents of the present petitioner. I find that only on the ground of incarceration other accused persons have been released on bail. Having considered the period of detention already suffered by the present petitioner in connection with the instant case and some 2 time will be required even to examine 13 witnesses proposed, I am inclined to release the petitioner on bail. As such, prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Abhijit Roy @ Lal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of districts of Kolkata and South 24 Parganas without prior permission of the learned Trial Court. Thus, CRM (M) No. 2002 of 2026 is allowed. The observations made above are only restricted for adjudication of the bail application and should not be considered a final opinion on the merits of the case. Status report and memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
