28.01.2026 Serial no. 51 [G.S.D] CRM (M) 2854 of 2025 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Panskura PS Case No. 939 of 2025 dated 16.10.2025 u/s 140(2)/140(3)/303(2)/61(2) of the BNS. -And- In the matter of : Sk. Maruful Islam @ Sk. Maruful … Petitioner(s) Mr. Himnshu De, Sr. Adv. Mr. Amal Kumar Samanta Ms. Monami Mukherjee … for the Petitioner(s) Mr. Z. N. Khan Mr. Atif Ahmed Siddiqui … for the State-respondent(s) Learned Senior Advocate appearing for the petitioner submits that the petitioner is in custody for 85 days and there was neither the name of the present petitioner in the FIR nor, there has been any recovery from the present petitioner. Additionally, it has been submitted that since charge- sheet has been submitted, the petitioner may be released on bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the statement of one of the victims under Section 183 of the BNSS as also points out regarding previous antecedents of the present petitioner. 2 Having considered that earlier the petitioner was charge-sheeted in similar types of offences, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM(M) 2854 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Report submitted be kept with the record. CD be returned to the learned advocate for the State. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
