The case of the prosecution is that the defacto complainant was induced by certain unknown persons, through social media, to invest money in the name of "Planet Image International Company IPO" and "Ant Retail Investor Alliance Club 222" by promising lucrative returns. Believing such representations, the defacto complainant transferred various sums of money to the accounts specified by them. Upon realizing that she had been cheated, she lodged a complaint before the Cyber Crime Police Station, Hubballi-Dharwad City, pursuant to which Crime No.0007 of 2024 was registered for the offences under Sections 419 and 420 of the IPC and Sections 66(C) and 66(D) of the Information Technology Act. During the course of investigation, certain bank accounts were traced to the petitioner, and consequently, a notice under Section 35(3) of the BNSS, 2023, was issued calling upon the petitioner to appear before the first respondent Police. Hence, the case. 3.The learned counsel for the petitioner would submit that an earlier anticipatory bail petition came to be dismissed under the mistaken impression that it related to a case pending on the file of the Tiruvottiyur Police Station. According to the learned counsel, the present petition seeks only interim inter- State anticipatory bail. He would further submit that the petitioner has received summons from the Hubballi-Dharwad City Police in Crime No.7 of 2024. It is his further contention that the petitioner is a permanent resident of Chennai and https://www.mhc.tn.gov.in/judis CRL OP No. 17433 of 2026 __________ Page3 of 5 has no relatives or acquaintances at Karnataka to effectively assist him in the proceedings. Therefore, he prays that this Court may protect the liberty of the petitioner. 4. The learned Government Advocate (Crl.Side), appearing for the respondent Police, reiterated the prosecution case and strongly opposed the grant of anticipatory bail to the petitioner. 5. From the materials placed before this Court, and considering the fact that the petitioner is a permanent resident of Tamil Nadu, that he has received summons in Crime No.7 of 2024 from the Hubballi-Dharwad City Police, and that he has no relatives or acquaintances at Karnataka to effectively assist him, this Court is of the considered view that it is a fit case to grant inter-State anticipatory bail to the petitioner for a period of four weeks. 6. Accordingly, interim interstate anticipatory bail is granted to the petitioner subject to the following conditions: (i) The petitioner shall surrender before the learned Judicial Magistrate Court, Thiruvottiyur, Chennai, within seven(7) days from the date of receipt of copy of this order; (ii) On such surrender, he shall be enlarged on bail on condition that he shall execute a bond for Rs.20,000/- (Rupees https://www.mhc.tn.gov.in/judis CRL OP No. 17433 of 2026 __________ Page4 of 5 Twenty Thousand only), with two sureties each for a like sum to the satisfaction of the said Magistrate. (iii) Within four weeks of such surrender before the above said Magistrate, the petitioner shall seeks appropriate relief before any of the jurisdictional Courts in the State of Karnataka.
