CONSEQUENTLY DISMISS THE SAID PETITION IN CRL.MISC.NO.469/2023 ON THE FILE OF THE ADDL.CIVIL JUDGE AND JMFC AT KRISHNARAJANAGAR. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER 1. The petitioner is before this Court calling in question the order of the concerned Court granting maintenance of Rs.16,000/- to the wife and the child. 2. The learned counsel for the petitioner - husband submits that the respondent on her own volition has left the matrimonial home when she was carrying the child and has never returned. Thus, sub-section (4) of Section 125 of Cr.P.C. would get attracted and accordingly, when the wife has left the house on her own, she would not be entitled for maintenance. The said submission is noted only to be rejected. The concerned Court after noticing all these facts has granted maintenance of Rs.16,000/- to the wife and the child. - 3 - HC-KAR NC: 2026:KHC:5907 CRL.P No. 63 of 2026 3. The learned counsel further submits that the petitioner is only a supplier in a food cart in Mysuru and therefore, he is not earning that much money to take care of the wife or the child, who is now two years old. The said submission is again noted only to be rejected in the light of the judgment of the Apex Court in the case of ANJU GARG Vs. DEEPAK KUMAR GARG - 2022 SCC ONLINE SC 1314, wherein the Apex Court holds that if the husband has no avocation of the kind that he has to take care of his wife and children, he has to search for a better job. In the light of the said judgment, the petition lacking in merit stands rejected. SD/- (M.NAGAPRASANNA) JUDGE PKS List No.: 1 Sl No.: 230
