CMP No. 7335 of 2026 __________Page 2 of 4 Common Order (Order of the Court was made by P.Velmurugan, J.) These civil miscellaneous petitions are filed to condone the delay of 60 days. The reason for the delay stated by the petitioner is that on 26.09.2025, a legal opinion was sought by the petitioner based on the impugned order dated
12.09.2025. It was opined that a civil/commercial recovery suit can be initiated under the Exit MOU, and an appeal can be preferred before the Hon'ble Division Bench of this Hon'ble Court against the impugned order. Thereafter, on 01.10.2025, an additional legal opinion was obtained advising that a challenge may be made before the Hon'ble Supreme Court of India. Subsequently, on 09.10.2025, legal opinion was sought regarding the maintainability of filing an intra-court appeal before the Hon'ble Division Bench of this Court against the impugned order dated 12.09.2025 and based on the opinion, the present appeal is filed. 2. The learned counsel for the respondent would submit that legal opinion is an internal communication and placed reliance on the judgment of the High Court of Delhi dated 20.02.2024 in FAO (COMM) 34 of 2024. https://www.mhc.tn.gov.in/judis

3. The learned counsel for the petitioner would submit that the judgment relied on by the learned counsel for the respondent is not applicable as the same is related to the Commercial Court and appeal before the Commercial Division.
Whereas the present appeal is not related to the Commercial Court and for the Commerical Court, there is 60 days period of limitation for filing the appeal, whereas in this case limitation period of filing appeal is 30 days. 4.However, the reasons stated in the affidavits are not satisfactory and the delay is sought to be explained only on the basis of internal communication and internal administration processes, which do not constitute sufficient cause for condoning the delay.
