DATED : 27 th AUGUST , 2026 Heard Mr Akshay Naik, learned senior Advocate for the petitioner. 2. At the outset, he fairly submits that, on instructions, he doesn’t wish to press prayer clause (a). 3. He further submits that though now the securitization application would be decided by the Tribunal at Aurangabad, the fact remains that in view of the initiation of Corporate Insolvency Resolution Proceedings (CIRP) the debt will have to be determined so also an application for grant of early hearing will have to be taken to the logical end by the Tribunal. 4. He further submits that even his willingness to deposit amount of Rs.90 crores can be considered and decided by the Tribunal if appropriate directions are given. 2026:BHC-NAG:11142-DB 2 107.wp.6564.2026.odt 5. Since the prayer is innocuous, without going into merits and demerits of the case, we direct the learned Debt Recovery Tribunal at Aurangabad to decide the interim application Nos. 813 of 2018, 1890 of 2025 and 1664 of 2026 within ten days from the production of order of this Court in accordance with law. 6. So far as deposit of Rs.90 crores is concerned, the application can be preferred by the petitioner/applicant before the Tribunal, who shall decide the same in accordance with law. 7. Liberty is granted to the petitioner to approach this Court in case any contingency arises. 8. The petitioner/applicant is directed to appear before the Tribunal on 31/08/2026. 9. It is made clear that the aforesaid directions are given, in view of the fact that earlier in Writ Petition No. 7081 of 2025, vide order dated 26.11.2025, this Court has directed the Tribunal to decide an application within a time bound period, however the same was not decided. The writ petition stands disposed of in the above terms. Pending applications, if any, also stand disposed of. No order as to costs. [RAJNISH R. VYAS, J] [ANIL S.
