Mr. M.K. Mohanty, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 24.03.2026
01.
1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Koraput Town P.S. Case No.5 of 2026 corresponding to G.R. Case No.20 of 2026 pending in the file of learned S.D.J.M., Koraput on the grounds stated therein.
3. Perused the FIR as at Annexuer-1. It is submitted to the Court that no one has been named in the FIR but the petitioners apprehend arrest in the hands of the local police. The alleged incident relates to snatching of mobile phone of the informant, who was along with her friend by then. Recorded the objection of the State. It is claimed that the petitioners do not have any antecedent. Considering the facts pleaded on record and the
submissions as above and since two unknown persons have committed mischief, as revealed from the FIR but the local police has frequented their house and belong to one village, this Court though not inclined to grant pre-arrest bail to the
petitioners, however, is of the view that they should be directed to surrender before the learned court below for being released on bail with suitable conditions imposed.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioners surrender within a fortnight from today before the learned S.D.J.M., Koraput in connection with Koraput Town P.S. Case No.5 of 2026 corresponding to G.R. Case No.20 of 2026, they shall be released on bail subject to them on furnishing a bail bond of Rs.30,000/- (Rupees thirty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, both shall cooperate the I.O. in the investigation, till it is over. It is further directed that the above
order shall not be given effect to if the petitioner is having similar antecedent.
6. Issue urgent certified copy as per rules.
