For Petitioner(s): Mr.Baskaran for Mr.N.Senthil Kumar For Respondent(s): Mr.M.Murali Vinodh, Standing Counsel for R1 and R2 Mr.C.S.K.Sathish, Standing counsel for R3 ORDER This writ petition is filed for the following relief: “directing the respondents to pay the difference / arrears of wages for the period from 01.09.2023 and also to pay terminal benefits namely Gratuity, Encashment of Leave, Provident Fund, Pension Arrears and to revise the pension on the basis of 12(3) settlement dated 29.05.2025 along with 12% interest p.a. within a time frame.” 2. Heard the learned counsel appearing on either side and perused the materials available on record. 3. The petitioners joined the service of the respondent corporation and retired on attaining the age of superannuation. It is the contention of https://www.mhc.tn.gov.in/judis WP No. 24197 of 2026 __________ Page3 of 6 the petitioners that they are entitled to the interest amount for the belated payments of their terminal benefits viz. Gratuity, Encashment of Leave, Provident Fund and Pension Arrears and difference amount of arrears of wages for the period from 01.09.2023 and pension not been revised as per the Section 12(3) settlement. 4. Therefore, the petitioners have made a representation to the respondents to pay them the interest for the belated payment of gratuity, encashment of leave, Provident fund, pension arrears and to revise pension as per Section 12(3) settlement dated 29.05.2025 along with 12% interest and the difference amount of arrears of wages for the period from 01.09.2023. However, the same had not been considered to date by the respondents. Hence, the petitioners are before this Court. 5. Considering the limited request of the petitioners and taking note of the fact that the petitioners representations have not been considered to date by the respondents, a mandamus, is therefore, issued to the respondents to pay the interest at the rate of 6% p.a., for the belated payment of the petitioners terminal benefits namely Gratuity, Encashment of Leave, Provident Fund, Pension Arrears and to disburse the eligible https://www.mhc.tn.gov.in/judis WP No. 24197 of 2026 __________ Page4 of 6 difference amount of arrears of wages for the period from 01.09.2023 and to revise pension as per the Section 12(3) settlement along with interest at the rate of 6% per annum to the petitioners within a period of one month from the date of receipt of a copy of this order. 6. Accordingly, this Writ Petition is disposed of. Consequently, connected miscellaneous petition in W.M.P.No.26315 of 2026 is ordered subject to payment of single Court fee.
