Learned advocate for the petitioner submits that the petitioner has been foisted with the criminal case due to change in administration. State opposes the prayer for anticipatory bail. I have taken into account the information which has been furnished and the facts of the case which emanates from July, 2023. Having considered the same, I am of the view that although the investigation may continue but custodial detention of the present petitioner is unwarranted.
2 Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Kakali Gupta Tah @ Kakali Gupta] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023. As the investigation is in progress, the petitioner shall meet with the I.O. of the case as and when she will be called upon by the I.O. for the sake of investigation. Additionally, the petitioner shall stay within the jurisdiction of Burdwan police station.
