Fancon, learned Legal Aid Counsel for the 2026:MLHC:702 2 applicant who has submitted that the applicant has preferred an appeal against the impugned judgment and order of conviction dated 10.08.2023 and impugned order of sentence of even date passed by the learned Special Judge (POCSO), East Jaintia Hills District, Khliehriat in Special (POCSO) Case No. 6 of 2022 and in doing so, a delay of 1003 days has occurred while preferring the related appeal. 2. The learned Legal Aid Counsel has further submitted that the applicant has no means to file for appeal. Again, on receipt of the brief regarding the instant accused person by the learned Legal Aid Counsel the overall delay has cumulated to 1003 days in preferring the related appeal and therefore the applicant has come with this instant application for condonation of the same. 3. The learned Legal Aid Counsel prays that the delay may be condoned as the same is not deliberate or intentional. 4. Mr. H. Kharmih, learned Addl. P.P appears for the State respondent and has no objection to the prayer for condonation. 5. On consideration of the prayer made, this Court is inclined to allow this application on being satisfied that the grounds cited contain sufficient cause. 6. Accordingly, the delay of 1003 days in preferring the related appeal is hereby condoned. 7. Registry to diarize the appeal and list the same for admission after 2026:MLHC:702 3 1(one) week. 8. Misc.
