Petition under Section 528 of BNSS has been filed on behalf of the petitioner seeking expeditious conclusion of trial in Criminal Case No.502/2015 titled as Ramgopal Sharma Vs. Mukesh Kumar Sharma pending before the learned Additional Civil Judge and Judicial Magistrate No.15, Bassi, Jaipur Metropolitan-I for offence punishable under Section 138 of the Negotiable Instruments Act, 1881 (for short, ‘N.I. Act’). 2. Learned counsel for the petitioner submits that a criminal complaint under Section 138 of N.I. Act was filed by the petitioner-complainant against the respondent in the year 2013. Counsel submits that the trial Court took cognizance in the matter and issued process to ensure the presence of the accused. He [2026:RJ-JP:10135] (2 of 2) [CRLMP-605/2026] further submits that more than ten years have passed but till date, proceedings in the aforesaid case filed by the petitioner have not attained finality. Counsel thus, prays that learned Additional Civil Judge and Judicial Magistrate No.15, Bassi, Jaipur Metropolitan-I may be directed to expedite the proceedings in Case No.502/2015 pending before him. 3. Taking into consideration the facts and circumstances of the case and in view of limited prayer made by learned counsel for the petitioner, so also considering the nature of proceedings pending before the trial Court and age of litigation, this Court deems it just and proper to request the learned Additional Civil Judge and Judicial Magistrate No.15, Bassi, Jaipur Metropolitan-I to make all endeavour to expeditiously conclude the trial in Case No.502/2015 titled as “Ramgopal Vs. Mukesh Kumar Sharma” pending before him, within a period of six months from the date of receipt of certified copy of this order while keeping in mind the provisions of Section 143 of NI Act, if there is no legal impediment. 4.
