For Petitioner : Mr.S.Sundarapandian For Respondents : Mr.D.Venkatesh, Counsel for the State of Tamil Nadu (Crl. side) O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The writ petition has been filed seeking writ of Mandamus directing the respondents herein to grant emergency leave to the petitioner's husband namely, Tamilvanan, S/o.Subramanian (PPD No. 692159) now confined in Central Prison, Madurai for a period of 30 days, without police escort. 2. Mr.S.Sundarapandian, learned counsel for the petitioner would submit that the petitioner's husband is now confined in Central Prison at Madurai, pursuant to the conviction passed in C.C.No.8 of 2013 on the file of the Special Court under the Tamil Nadu Protection of Interests of Depositor (in Financial Establishments) Act, 1998, Madurai. Page No.2 of 6 https://www.mhc.tn.gov.in/judis W.P(MD)No.3470 of 2026 The petitioner and convict prisoner's daughter is suffering from Viral Hepatitis Jaundice and the petitioner sought emergency leave for the convict prisoner, since his presence is absolutely necessary for the medical care and welfare of her daughter. Hence, the petitioner had sent a representation dated 18.06.2026 before the prison authorities, since the same has not been considered so far, the petition has come up with the present writ petition before this Court. 3. Mr.D.Venkatesh, learned Counsel for the State of Tamil Nadu (Crl. Side) appearing for the respondents would submit that since the representation was not accompanied with a medical certificate, the respondents have rejected the request of the petitioner. 4. At this juncture, the learned counsel for the petitioner submitted that the petitioner and convict prisoner's daughter fell ill, when she had gone to Chennai and she has been diagnosed by a Doctor at Ambattur and the daughter is now taking further treatment at Nagapattinam at their residence. The medical certificate issued by the Doctor at Chennai is also enclosed in the typed set. Taking into consideration the fact that the petitioner and the convict prisoner's daughter is suffering from viral hepatitis, jaundice, we are inclined to direect the first respondent to grant 3 days emergency leave to the convict prisoner without escort, on the following conditions: (i) The convict prisoner namely, Tamilvanan, S/o.Subramanian, (PPD No.692159) now detained in the Central Prison, Madurai, shall be granted emergency leave for three days from 08.07.2026 to 10.07.2026. (ii) The convict prisoner shall be released from the prison at 7.00 a.m., on 08.07.2026 and he shall surrender before the prison authority on 11.07.2026 before 10.00 a.m. (iii) The convict prisoner shall appear and sign before the 2nd respondent police daily at 06.30 p.m., without fail. With the above direction, the Writ Petition stands allowed. No costs.
