29.09.2026 Court No.35. D/L.01. Rakib (Partly Allowed) CRM (M) 1929 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bhimpur Police Station case no. 100 of 2026 dated 29.03.2026 under Sections 103(1)/3(5) of the Bharatiya Nayaya Sanhita, 2023. And In the matter of : Ratan Mondal & Anr. ……Petitioners. Mr. Sumanta Das .....for the Petitioners. Mr. Pradip Banerjee Mr. Arijit Banik ……for the State. Learned advocate appearing for the petitioners submits that petitioners were having dispute with the family of the deceased in relation to the ancestral property and subsequently foisted with the present criminal case, charge-sheet has already been submitted and the petitioner are in custody for more than five and half months. As none appeared for the State on earlier, Mr. Pradip Bannerjee, learned advocate is directed to appear for the State with a junior of his choice. Their appointment may be regularized by the concerned authorities. Learned advocate appearing for the State opposes the prayer for bail as the vital blow was inflicted by petitioner no.1 and at the same time petitioner no.2 caught hold of the deceased for facilitating the petitioner no.1 to commit the alleged offence. 2 I have taken into account the overall materials of the case, the period of detention and the genesis of the case resulting to dispute of ancestral property. Petitioner no.2 is a lady. Having considered that there are no criminal antecedents, I am inclined to release the petitioner no.2 on bail. As such, prayer for bail of the petitioner no.2 is allowed. So far as the petitioner no.1 namely, Ratan Mondal is concerned, his prayer for bail is rejected. As such, the petitioner no.2, namely, Kakali Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Krishnanagar, Nadia. If on bail, the petitioner no.2 shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Nadia without prior permission of the learned Trial Court. Thus, CRM (M) No. 1929 of 2026 is partly allowed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
