For Petitioner : Mr.R.Murugaboopathy For Respondents : Mrs.K.R.Shiva Shankari counsel for State 2/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.15954 of 2026 ORDER This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the second respondent to consider and dispose of the petitioner's representations dated 27.11.2025 and 27.01.2026 and consequently direct the respondents to take appropriate steps to remove the alleged unauthorized construction of an overhead water tank. 2.The learned counsel appearing for the petitioner submitted that the petitioner is the owner of the land comprised in Survey No.234/4B. According to the petitioner, the respondents have constructed an overhead water tank in the said property without acquiring the land and without paying any compensation. In this regard, the petitioner submitted representations dated 27.11.2025 and 27.01.2026 requesting the authorities to remove the alleged unauthorized construction. Since no orders have been passed on the said representations, the petitioner has approached this Court by filing the present Writ Petition. 3/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.15954 of 2026 3.The learned counsel appearing for the petitioner fairly submitted that it would suffice if this Court issues a direction to the first respondent/District Collector to conduct an enquiry, after affording an opportunity of hearing to the petitioner as well as the officials of the Revenue Department and other necessary parties, if any. It is further submitted that, if upon such enquiry it is found that the overhead water tank has been constructed in the petitioner's property, the first respondent may be directed to pass appropriate orders in accordance with law within a time frame to be fixed by this Court. 4.Considering the limited relief sought by the petitioner, without expressing any opinion on the merits of the claim, the first respondent/District Collector is directed to consider the petitioner's representations dated 27.11.2025 and 27.01.2026, conduct an enquiry after affording an opportunity of hearing to the petitioner and all other necessary parties, verify the relevant revenue records and other materials, and 4/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.15954 of 2026 thereafter pass appropriate orders on merits and in accordance with law, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. 5.
