And In the matter of : Durga Barman @ Durgadeb ……Petitioner. Mr. Kaushik Choudhury Mr. Dwipayan Panda Mr. Tridib Das ……for the Petitioner. Mr. Arijit Ganguly Mr. Akash Ganguly ……for the State. Learned advocate for the petitioner submits that petitioner is in custody for 6 months and 25 days and there were alleged recovery of 299 bottles of Phensedyl from the joint possession of the petitioners. It is further submitted that charge sheet has already been submitted. Learned advocate for the State opposes the prayer for bail and submits that 3 accused persons are still absconding. Having considered the present stage of the case, I direct the learned Special Court to exhaust the process of law, split up the trial of the case, if required, overcome the stage of consideration of charge at the earliest by adhering to the 2 provisions of law and thereafter release the petitioner on bail after the charges have been framed. With the aforesaid observations, CRM (NDPS) 491 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
